The Minnesota Pollution Control Agency (MPCA) is currently requesting comments on its planned amendment to rules to reduce ground water risks and financial risks when locating solid waste landfills. The Agency plans to prepare rules to determine where solid waste landfills may be located based on geologic, hydrologic and other relevant physical site conditions (together called “intrinsic suitability”). The other considerations relevant to risk management may include waste characteristics and site infrastructure. MPCA also will address financial assurance for solid waste landfills.
The public comment period ends January 15, 2009. After that date, MPCA expects to begin drafting rules regarding solid waste landfill siting and financial assurance to reduce risks to ground water.
By January 15, 2010, MPCA must deliver a report to the Legislature on proposed rules to prohibit the disposal of solid waste in specific areas due to the sensitivity of the area to ground water contamination. Following its report to the Legislature, MPCA plans to proceed to develop and propose final rules.
