MPCA Industrial Pretreatment Requirements – Non-delegated POTWs

The new wastewater pretreatment rules (Minnesota Rules 7049), which were proposed in November 2007, are now in effect.

The new rules have special requirements for Publicly Owned Treatment Works (POTWs) that have not been delegated authority to oversee their own Federally-enforceable pretreatment program. This includes the majority of POTWs in the State. Generally, it is the responsibility of every POTW to control the contribution of industrial users that discharge to the POTW plant to prevent interference or pass-through and require industrial users that discharge to the POTW to comply with the general and specific prohibitions.

In brief, non-delegated POTWs are required to set specific local effluent limits or best management practices for industrial users and all other users, as appropriate. POTWs must also submit a Pretreatment Annual Report to MPCA if they have any Significant Industrial Users. [definition of “Significant Industrial Users"]

A POTW that is not delegated pretreatment authority must notify MPCA of any:
(1) significant industrial user discharging to the POTW not previously reported;
(2) anticipated or actual changes in the volume or quality of discharge by an industrial user that could result it becoming a significant industrial user; and
(3) anticipated or actual changes in the volume or quality of discharge by a significant industrial user that would require changes to the local limits.
