MPCA has proposed a significant revision to its fee structure associated with air and water permits. The proposed amendments are in three main areas of change. First, the amendments develop a formula for the calculation and collection of fees associated with air and water permit applications. The permit fee formula would be adjusted biennially based on the level work actually required for air and water permitting activities.
The second area addressed is the establishment of application fees for air quality permits and modifications similar to how fees are assessed for water quality permit applications. The amendments establish an application fee that correlates to the level of effort required to develop and issue a permit. To accomplish this, a point system is established for different types of permit-related activities.
The third area involves adjustment of the existing rules regarding the administrative aspects of how fee payments are made and also to update the existing annual water fees to make them consistent with the fees as modified by the Legislature in 2002.
The new fee rates will be effective on July 1, 2009. Permit applications processed after July 1, 2009 and before implementation of the rule are subject to the new fees and will be charged retroactive fees, as necessary. The rule has now entered the formal public comment stage of the rulemaking process with public hearings scheduled on July 28, 2009.
