Tier 2 - Tier II Chemical Inventory Reports in Minnesota

What is EPCRA?EPCRA (Emergency Planning and Community Right-To-Know Act) is a law designed to inform communities and emergency responders about chemicals and chemical hazards present and transported in the community. Under EPCRA, a facility potentially subject to regulation includes all buildings, structures, equipment, and other stationary items located at the same single place and controlled or operated by the same entity.

Under EPCRA 311 and 312 notification of chemical storage and annual chemical inventory reports (Tier II reports) and emergency plans required from facilities by EPCRA.

How is EPCRA 311-312 Implemented In Minnesota?In Minnesota, the requirements of EPCRA 311-312 are supplemented through Minnesota Rules Chapter 7513, Hazardous Substance Notification. Facilities can either submit a "Tier 1 - Emergency and Hazardous Chemical Inventory" form or a facility may submit a Tier 2 form, "Emergency and Hazardous Chemical Inventory".

What is a Tier 2 Report?EPCRA requires that facilities submit certain annual EPCRA reports with the local fire department, and other emergency response agencies. These reports are called Tier 2 Reports. Tier 2 reports summarize the storage of hazardous materials at the facility. All materials that exceed threshold planning quantities (TPQ) are to be reported. These TPQ are 10,000 pounds for most hazardous materials, however for some common materials, the TPQ can be significantly less – sometimes as little as 10 pounds.

What Are Hazardous Materials Under EPCRA?Materials that require reporting under EPCRA 311/312 include any materials which are defined by OSHA as being potentially hazardous, and require an MSDS, or listed as hazardous substances. This includes many types of materials which would not be considered by most facilities as "chemicals".
